TERMS OF SERVICE

1. ELIGIBILITY AND ACCOUNTS

Eligibility. You must be of legal age and legally permitted to purchase and use firearms, ammunition, and reloading components where you live. You must meet the minimum age required by the federal, state, and local laws that apply to you — generally at least 18 years of age, and 21 years of age where required for the products or components involved. By using the Services, you certify that you meet these requirements.

Account registration. To use the App you must provide a valid email address and create a secure password. You are responsible for keeping your credentials confidential and for all activity under your account, and you agree to notify us promptly of any unauthorized use.

Accurate information. You agree to keep your account information accurate, current, and complete.

2. ORDERS, SHIPPING, AND RETURNS

Store pricing is shown in U.S. dollars and may change at any time. We accept orders at our discretion and may cancel or refuse an order. Shipping timeframes are estimates, not guarantees. Returns and our satisfaction guarantee are described on our Guarantee page; please review it before purchasing. You are responsible for complying with all laws that apply to purchasing, receiving, and using the products you order.

3. SUBSCRIPTIONS AND BILLING (QUAL8 APP)

Plans. The App offers subscription tiers with different features and pricing, shown at signup and in your account settings. Subscriptions bill on a recurring basis as specified at purchase.

Payment. Subscription payments are processed by our third-party payment processor. By providing payment information, you authorize us and our processor to charge your payment method for the fees and applicable taxes. We do not store full payment card numbers.

Renewal and cancellation. Subscriptions renew automatically at the end of each billing period unless canceled beforehand. You may cancel anytime in your account settings; cancellation takes effect at the end of the current period, and no refunds are provided for partial periods.

Data across tier changes. Your data is preserved across subscription tier changes. Downgrading freezes access to gated features but does not delete your data, and upgrading restores access to your previously archived data. This preservation is subject to your right to request deletion of your data and to our data and photograph retention practices, both described in our Privacy Policy.

4. YOUR RESPONSIBILITIES

You are solely responsible for the data you input into the App, including shooting data, rifle specifications, and measurements, and for its accuracy and legality. You are responsible for securing your account, for complying with all applicable local, state, and federal firearms laws and regulations, and for using the Services only for lawful purposes and in accordance with these Terms.

5. ACCEPTABLE USE

You agree not to: violate any law or third-party right; attempt to gain unauthorized access to, hack, or tamper with the Services; transmit viruses or harmful code; reverse engineer or attempt to derive source code; scrape or use bots except approved accessibility tools; harass or abuse others; use the Services for illegal activity; or resell or commercially exploit the Services without authorization. We may suspend or terminate accounts that violate this policy.

6. INTELLECTUAL PROPERTY

The Services, including all content, features, functionality, design, code, trademarks, and materials, are the property of Sigma8 Labs, LLC and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to access and use the Services for your personal use only. “Qual8,” “Sigma8 Labs,” and associated logos are our trademarks and may not be used without our written permission. Certain Qual8 features, workflows, methods, designs, analytics, and related technology may be protected by pending patent applications and other intellectual property rights owned or controlled by Sigma8 Labs, LLC. No rights are granted except as expressly stated in these Terms.

7. YOUR CONTENT AND DE-IDENTIFIED DATA LICENSE

You retain ownership of the data and photographs you upload to the App, including your equipment records, target photographs, and shooting data (“Your Content”). You grant Sigma8 Labs, LLC a worldwide, non-exclusive, royalty-free license to host, store, process, and display Your Content as necessary to provide the Services to you.

You also grant Sigma8 Labs, LLC a perpetual, irrevocable, worldwide, royalty-free license to create de-identified and aggregated data from Your Content and to use that de-identified and aggregated data for any lawful purpose, including improving our products and computer-vision systems, conducting research, and building and maintaining our reloading and ballistic datasets. De-identified and aggregated data cannot reasonably be linked back to you. This license survives termination of your account and any deletion of Your Content. Our handling of personal information is described in our Privacy Policy.

8. FIREARMS, RELOADING, AND ASSUMPTION OF RISK

Sigma8 Labs products and the Qual8 app relate to firearms, ammunition, and the reloading (handloading) of ammunition, which are inherently dangerous activities that can cause serious injury, death, or property damage.

The Qual8 app records and quantifies measurements you provide and derives analysis from them. The Qual8 app does not generate, prescribe, validate, or recommend load data, and is not a load manual. Any charge weights, seating depths, velocities, or other figures shown reflect what you entered or what was measured from your targets; they are not safe-load recommendations. You must independently verify all load data against current published data from the powder, bullet, and cartridge manufacturers and SAAMI before loading or firing any ammunition.

You are solely responsible for the safe and lawful handling of firearms, ammunition, components, and reloading equipment, and for compliance with all applicable federal, state, and local laws. You assume all risk arising from reloading, from the use of any data, analysis, or recommendation provided through the Services, and from the use of any products purchased from us. To the fullest extent permitted by law, Sigma8 Labs, LLC is not liable for any personal injury, death, or property damage arising from these activities.

9. DISCLAIMER OF WARRANTIES

The Services are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Qual8 provides shooting analytics and ballistic calculations for informational and educational purposes only; it is not a substitute for professional instruction. We do not warrant that the Services will be uninterrupted, error-free, or available at all times.

10. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Sigma8 Labs, LLC is not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, loss of data, or interruption of service. Our total liability for any claim will not exceed the amount you paid us in the 12 months preceding the claim, or $50.00 if you have made no payments. We are not liable for shooting outcomes, injuries, inaccurate calculations, data loss, or third-party service-provider failures.

11. INDEMNIFICATION

You agree to indemnify and hold harmless Sigma8 Labs, LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Services, your content, your violation of these Terms or applicable law, or shooting outcomes resulting from your use of the Services.

12. SUSPENSION AND TERMINATION

You may terminate your account at any time. We may suspend or terminate your access to the Services if you breach these Terms or use the Services unlawfully. On termination, the data-license terms above continue to apply to de-identified and aggregated data, and data is handled in accordance with our Privacy Policy.

13. GOVERNING LAW AND DISPUTES

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles. You consent to the exclusive jurisdiction and venue of the state and federal courts located in Colorado (Weld County) for any dispute. Before pursuing legal action, please contact us at support@sigma8labs.com to attempt to resolve the matter.

14. GENERAL PROVISIONS

These Terms, together with our Privacy Policy, are the entire agreement between you and Sigma8 Labs, LLC regarding the Services. We may update these Terms; material changes will be communicated and continued use constitutes acceptance. If any provision is found invalid, the remaining provisions stay in effect.
